Belviq Cancer Lawsuit

Belviq & Belviq XR Cancer Lawsuits

If you developed cancer after taking Belviq or Belviq XR, contact Mass Tort Alliance immediately to discuss your legal options. You may be entitled to financial compensation from the manufacturer. Eisai Inc. initially manufactured and marketed the drug for weight loss. However, they didn’t disclose the potential risk of cancer until years later. People across the country have been filing lawsuits against the drug company for their negligent actions, which led to the victim’s cancer diagnosis and other medical complications.

Manufacturers are responsible for providing products that are safe for consumers. If they know of any potential dangers, they must include them on warning labels. The Belviq manufacturer knew about the adverse side effects patients could face but chose not to notify them. That decision resulted in thousands of people developing some type of cancer and experiencing other serious side effects.

Mass Tort Alliance understands how traumatic this experience has been. Cancer is a life-changing diagnosis. Many cancer treatment options come with their own side effects that could disrupt your daily life. Unexpected medical bills are a significant source of stress and could lead to debt if you’re unable to pay. You deserve compensation for the suffering you’ve endured, and we’re ready to help.

What Is Belviq?

Belviq is the brand name for lorcaserin hydrochloride. It belongs to the drug class CNS Stimulants, Anorexiants, Serotonin 5-HT2C-Receptor Agonists. When used correctly, it can treat people with obesity and other weight-related problems. It is a doctor-prescribed medication that comes in the form of a tablet.

The U.S. Food and Drug Administration (FDA) approved Belviq for weight loss in 2012. The active ingredient lorcaserin affects brain signals indicating hunger. The chemical reaction can cause a feeling of fullness, so the patient eats fewer calories. Belviq XR is an extended-release tablet. Both are useful for weight loss when combined with exercise, diet, and other lifestyle changes.

Common Side Effects of Belviq and Belviq XR

Multiple side effects and complications can occur while taking or after completing a lorcaserin regimen. They range in severity from mild to severe. The most common are:

  • Anxiety
  • Fatigue
  • Headache
  • Dry mouth
  • Dizziness
  • Blurry vision
  • Toothache
  • Constipation
  • Trouble falling asleep or staying asleep
  • Back or muscle pain
  • Cough

More serious side effects include:

  • Hallucinations
  • Nausea and vomiting
  • Nipple swelling or discharge

Researchers discovered a potential link between Belviq and different types of cancer. Although this link is not definitively proven, studies have shown an increased risk of adverse effects. The most common cancers that could form are:

  • Lung cancer
  • Pancreatic cancer
  • Colorectal cancer

If you were diagnosed with cancer or experienced unusual side effects, you should talk to your doctor. Just because you took Belviq doesn’t necessarily mean you’ll get cancer or that your cancer diagnosis is because of the medication. However, it would be a good idea to contact Mass Tort Alliance, so we can review your case.

Five-Year Study Prompting a Withdrawal of Belviq and Belviq XR

The FDA requested Eisai to perform a study of the potential side effects of lorcaserin. The manufacturer conducted a double-blind clinical trial with around 12,000 women and men over five years. The participants were at an established or high risk of cardiovascular disease. During the trial, one group was given a placebo, and the other took the lorcaserin.

The FDA reviewed the study results and determined that the risks of taking the drug outweighed the benefits. In the placebo group, 423 people developed cancer. Out of the patients who took lorcaserin, 462 were diagnosed with cancer.

On February 13, 2020, the FDA requested Esai to remove all lots of Belviq and Belviq XR from the market. They also urged patients to stop taking the prescription immediately and speak to their doctors about beginning another weight loss regimen. The manufacturer decided to issue a voluntary withdrawal of all lorcaserin medications in the United States.

Pending Lawsuits Against Eisai, Inc. for Belviq Defects

There haven’t been any jury verdicts or settlements reached in lawsuits against Eisai, Inc. Many cases were filed recently or have been pending for a time. The compensation you’re entitled to will depend on various factors related to your case. An experienced attorney can review all the information and determine how much money you need to compensate for your past and future losses.

Compensation Available in a Product Liability Case

A product liability case is the means for holding companies liable for causing injuries to consumers. Eisai Inc. manufactured and sold a dangerous drug that led to countless cancer diagnoses and medical problems. When you file a lawsuit, you can pursue compensation for the losses you suffered due to your injury or disease.

The most common losses included in compensation are:

  • Medical bills
  • Mental anguish
  • Physical impairment or disfigurement
  • Disability
  • Lost wages
  • Lost earning capacity
  • Pain and suffering
  • Loss of consortium
  • Diminished quality of life

Cancer often requires chemotherapy, radiation, and other types of treatment. All of that costs money, and you shouldn’t be the one to pay. The manufacturer should be held accountable for what they’ve done and provide the necessary compensation to cover your losses.

Deadlines for Filing A Lawsuit

When you file a lawsuit, there’s a strict deadline you can’t miss. If it passes and you try to file anyway, the court will likely dismiss your case. The timeframe for suing the Belviq manufacturer is known as a statute of limitations. Every state has its own statute, and in cases like these, the deadline can be anywhere from one year to six years from the date you discover your injury or illness. It’s critical that you pay attention to how much time you have and begin the legal process as soon as possible. Your attorney can handle the legal aspects of your case, so you don’t have to worry about the deadlines.
