New York Labor Laws

New York Labor Law Section 191 requires companies to pay its employees who spend at least 25% of their work time engaged in manual labor (i.e., cashier, stocking shelves, cleaning, assisting customers, receiving inventory, etc.) on a weekly basis. Companies like Dick’s Sporting Goods and DSW that pay these employees every other week are violating this law.

Employees that are paid biweekly in violation of this law may be entitled to significant compensation. New York Labor Law entitles these employees to make a claim for an additional payment of half of the wages earned (even if they were already paid in full).

For example, a Harbor Freight employee for a similar arbitration who earned $50,000 over the last six (6) years may be entitled to an additional $25,000.
